Legal Question in Wills and Trusts in Georgia

Will

Decease family member - will which we found was probated -- but has not been completed - found another hand written will dated later but was not witness but All in both will agree it was in her own hand writing and agree that is what she wanted - we are a close net family and want to carry out her last wishes Please give us advise - we all want to use the hand written Will

Without seeing the documents, no one can really advise you here. Depending on the details, if all the heirs agree, it may be possible to draft documents that would accomplish what you ask. If you're in metro Atlanta call me to discuss this and we might be able to help.

If all of the heirs under the probated will are competent adults, they may unanimously agree to any disposition of the decedent's property.

You should ask an attorney to review the probated will to make sure that there are no provisions which might result in a minor or unborn person being an heir.
