Legal Question in Wills and Trusts in Georgia

last will in ga

My father passed a way leaving my sister and I excutors of his estate in his will. He did not leave any instructions on how to provide for his wife/ my mother in this will. He did not mention her by name in any way. We are in the state of Ga.

IS this will valid?

No one could answer that without reading the will. Feel free to call me for an appointment if I can assist you.

Without actually examining the will, I cannot say if it is valid.

If it is validly executed, leaving your mother out of the will does not invalidate it. However, she may be able to declare it invalid on the grounds of incapacity, undue influence, or other grounds.

If the will survives that challenge, she does have the right to apply for and receive a year's support from the estate.

You should consult an attorney to resolve these issues.
