Legal Question in Workers Comp in Georgia

Not receiving full benefits of Workmans Comp wage or treatment

I was injured on 5/17/01 lifting a patient. Result of a torn rotator cuff in my right shoulder. My company workman comp ins states that in Ga they cannot pay me the 2/3rds wage with my built in overtime pay. I work a 24hr shift and off for 48hrs (24/48). They state that they are still waiting to here from their Ga atty, which has been over a month now. They still have not paid me for the first 4 shifts that I was out, and they have been stating for 2 wks now that they are sending it today. The doctor wants me to have cervical PT which still has not been approved for 2 weeks now by workmans comp. I have been very patient with all of this, which is causing my credit rating to go bad. I have had excellent credit for 20 yrs, now this is ruining my credit and my career as a paramedic (I may never be able to do my job with this type of injury again). What should I do, wait and be patient since they are paying me?

You should at least file a claim on your own. It would be wise to consult with an atty since, if you are from out of state, you may also be able to file in your state if the benefits are higher. Also, you should investigate whether you have a claim against party, other than your employer, for your injury.
