Legal Question in Workers Comp in Georgia

true workman's comp

I was injured today at work (outside, surveying a creek bed to be turned into a storm runoff).

I was not able to fill out an incident report, but I did tell the supervisor that I was hurt.

I'm going to the Dr. tomorrow, and I would like to know: What is the proper way to get honest workman's comp? I believe my employer intends not to pay at all.

By law you do not have to fill out an incident report. As long as you notified your employer (thro a supervisor) about your injury, you have done what you need to do. Your employer is required to have a posted panel of physicians from which you must chose a doctor to treat with. Technically, if your employer doesn't have a panel, you can see any doctor you want. If your doctor takes you out of work for seven days or more, your employer (within 21 days) must either pay you benefits or file the appropriate paperwork controverting (denying) your claim. Be sure to ask to see the list of doctors that your employer will authorize for treatment. The list should be on a pink sheet of heavy paper. He may just give you a name. Make sure you follow up with the doctor. If you have other questions about your particular problems, you should probably see a lawyer in your locality just to be sure that proper procedure is being followed.
