Legal Question in Workers Comp in Georgia

w/c benefits

i fell off a house 3/17/2005 and broke my hip .i found out 6 months later my boss had w/c .i filed a claime before 1yr was up.will i get back pay benefits from the time i was injured or when i filed. how long before benefits start.i am still unemployed and need more medical help.

If there was coverage, you should get benefits for the entire time that a doctor kept you out of work. However, it sounds like there has been too much delay with your benefits and medical treatment. I think that you need to request a hearing with a judge. Otherwise, the insurance company will continue to drag their feet. My firm handles cases all over the State of Georgia. Your workers' compensation benefits will be payable from the date that you can prove that you were totally disabled, or partially disabled but performing a diligent job search. Since you haven't been paid yet, you may also have to prove that you were injured on the job. That should not be a problem considering you fell off a house.
