Re: workers compensation

The maximmum benefit for that rating is 45 times (or 45 weeks) your weekly comp benefit (2/3 average weekly wage). Fore example, if your comp benefit is $200/week your permanent partial disability due would be $9,000. Please call if you have any questions. 404.728.8027.

Re: workers compensation

The question has two aspects to its answer. The first is that a part of the compensation scheme established under Georgia Law is to formulate a way to equate impairment ratings to indemnification payments. 15% to the whole body equates to 45 weeks. Depending on the employee/claimant's average weekly wage at the time of the injury and the compensation rate resulting therefrom, the maximum amount to be attributed to indemnification for lost wage can be identified by multiplying 45 weeks times the compensation rate. However, this is not necessarily, the maximum amount the injured employee can receive. His claim can be settled on a close-out basis and depending on the facts and circumstances of the case, the settlement could be several times the amount of the indemnification for lost wages. Factors such as the employee's ability to return to full duty, the potential for deterioration of the employee's physical condition and hence the possibilty that he will go back on compensation, future medical care and the like all factor in the calculation of a reasonable settlement in a particular case. If you have all the information readily available, an attorney familiar with workers' compensation claims can give you an idea what may be a reasonable range of settlement in your particular case. I recommend that you hire counsel if you are not already represented, and allow a professional negotiate your claim. Even after paying the attorney a percentage, you will realize far more than you will realize if you try to negotiate your own settlement.
