Can I take him back?

I am Trinidadian and my X is Guyanese. we have--name removed--son (3 months). Born in Trinidad. Lives now with his mom in Guyana. She does not work and I support financially. Does not support her daughter (not mine) but ''expects'' me too. I want my son to have an education in Trinidad but she resists! Claims that Guyana education systems is as good but i know it is not! Can i take my son back for his education? He already have his Trinidad passport. She wants--name removed--Guyanese passport for him but I am resisting. I will not stop her from visiting or carrying him back to Guyana. Want what is best for him.

Custody of 3 month child

In the exercise of its discretion to determine custody of a child, the Courts are guided by the principle that the child�s welfare is of paramount importance.

In the case of your son who is 3 months old, the balance of convenience is in favour of the mother unless the burden can be discharged by compelling circumstances, given that you reside in a different jurisdiction. At 3 months old, the issue of education would not be a relevant consideration.
