Legal Question in Discrimination Law in Hawaii

old age discrimination

Is is legal for a boss (this is a principal in an elementary school) to tell someone that their mind is bad and not able to do their job, even though they are doing their job and getting good evaluations. She told her that her mind had reached it's potential and could no longer handle that position and it would be best if she quit.

Re: old age discrimination

Is it legal for a person to state an opinion? Of course it is. We do not know whether the person made the comment because they had, or thought they had, a valid basis or for some other reason, so we can't guess or speculate. The general issue is whether there has been actual adverse action taken solely because of age, as opposed to ability. See a local lawyer if you wan to go over all details.
