Legal Question in Personal Injury in Hawaii

scar

I encountered an injury at a Lowes Home Improvement Store that resulted in a 24 cm scar down my leg. Per the dr.'s exam, ''Edges well approximated, healed with smooth non raised scar. No erythema, no swelling, no pain or signs of inflamation.'' No work was missed.

What would be a fair compensation as a result from this scar?

Thank you for your question. The value of your claim will depend on a number of factors such as (1) the amount of your medical bills; (2) whether the scar can be reduced or eliminated by scar revision surgery (and what that future surgery will cost); (3) the amount of lost wages if any; (4) the extent of your pain and suffering; (5) whether or not the scar could affect your employment, ie. if you are a model and the scar will prevent you from getting modeling jobs, etc.; and (6) whether you were partially at fault in causing the injury, ie. not watching where you were walking (in Hawaii, the value of your case can be reduced by the percentage of your own negligence - if you are 51% or more negligent you cannot recover - thus if you are more negligent that Lowes, then you are barred from any recovery. If the scar cannot be reduced or eliminated you will have a claim for disfigurement but generally it is best to wait until some time has passed because most scars will reduce somewhat over time. There is no magic formula for scarring, but after considering the factors mentioned above, a range can be determined based upon what prior similar cases have either settled for or based upon what juries have awarded in such cases.
