Does a durable power of attorney form have to be filed in court or can it simply be notorized to be honored in the state of Georgia?

The answer depends on how it is to be used. If real estate may be transfered using it, it must be executed with the same formality as a deed, and must be recorded.

If you are talking about a durable healthcare power of attorney, it does not have to be notarized but it does require two witness, who can be anybody.
