Legal Question in Criminal Law in Idaho

Child Sexual Abuse, Punishment and Sentencing

What are the minimum sentencing requirements for ANY sexual offence against a minor (under the age of 16). I am specifically looking for confirmation or denial of a statement I was given that a person convicted of a sexual offence against a child is not allowed to live within 5 miles of an elementary school. Is this true? Where can I find that law? Does it apply only to elementary schools or also to middle and high schools? Also, is there a requirement that secondary schools be notified that a sexual offender lives within their boundaries?

Re: Child Sexual Abuse, Punishment and Sentencing

I have reviewed the Id statutes involved at 18-8301 and following. There is no requirement in the statute that schools be notified, but the offender must register with the state and sheriff in a public registery. nothing in the statute says anything about not moving near schools.
