a business competitor is contacting our customers and telling them we are being sued and are going out of business this is not true we have never been sued and are not going out of busisses how can we stop this competitor from spreading lies and stealing our customers

Thank you for your question. The legal name for your claim is "tortious interference with business expectancy". You could sue them for reasonable damages incurred because of their misrepresentations. Specifically, the dollar amount would be something in the neighborhood of the revenue you lost because of the misrepresentations. You may wish to start by first sending a cease and desist letter to put them on notice, however. I would welcome any opportunity to speak with you further. You need to do the following: 1) have a lawyer send a cease and desist letter asap, if they fail to stop, you need to have a lawyer file for an injunction. 2) Additionally, if you know for a fact that you have lost business because of these actions, you can sue for damages.
