Legal Question in Business Law in Illinois

what constitutes breach of contract

I have an auto repair shop and subletted a job to a third party and the third party was unable to make the repair. As a result, the people that own the car want to sue me after they signed an estimate saying that the job was being subletted.

Re: what constitutes breach of contract

They have rights to sue you since their contract for repair was with you. Even though you subcontracted the repair you have the primary responsibility to make the repair. You can assign your rights but never your duties.

Usually you are liable, BUT I would have to see the contract to make an informed decision. If you would like to show me the specifics, and discuss them, feel free to contact my office.
