lawsuit

A credit card company has demanded full payment on bill or will send sheriff with summons and lawsuit.

We have had past financial problems and are trying to stay out of bankrupcy. What are our options?

If the creditor refuses to accept monthly payments and they are under no obligation to do so then they have the right to file a suit against you. My advice is to try very hard to establish a payment plan with them. If you fail to do so and a suit is filed then make sure you appear in court to protect your rights.

If your finances are such that you owe other bills and can not afford to pay those bills then perhaps filing bankruptcy is what you need to do. But, find a bankruptcy attorney and go see him or her so they can review your financial condition and properly advise you.
