money owed to health club

I joined a hc and made arrangements for them to take the dues out of my acct automatically. They never did and my husband (who I'm in the process of divorcing) never told me that nothing was coming out of the acct. Now they say I owe them $569. Because I made arrangements for them to do this in the first place and they didn't, am I liable? If so, can I legally make payments of $20 a month? I have ended the membership so can they continue to acrue late fees of $10 monthly? I can't afford to pay this large amount. If it had been taken out monthly as it should have been, it wouldn't have been a problem. Now it is. Please let me know. Thanks very much.

You still ow them the money, no matter how it wasn't paid. Have your attorney make it part of the marital settlement agreement.
