Legal Question in Criminal Law in Illinois

i have been charged with o w i for having half a marijuana cigarette i have no previous record or convictions but i know how this offense can have a terrible affect on my life and future im very concerned what will happen because im aware how serious that offense is.

what advice may you have for this situation, also i was asked several questions and placed in handcuffs before i was ever told im under arrest and read my miranda rights does that have any benefit on my behalf? please help thank you

Hello. You certainly should have an attorney representing you. In my opinion, an attorney representing you should make certain that he or she is given copies of all evidence against you in order to prepare a proper defense for you. It must first be determined whether the police had a basis for placing you under arrest. If the police had no reason to suspect that you were in possession of marijuana, before searching you, then it may be possible to suppress the evidence, namely the marijuana. In other words, if your case went to trial, the State would not be able to mention the marijuana to a jury or to a judge hearing your trial. This is a serious matter that you are faced with.
