Legal Question in Criminal Law in Illinois

Illinois Law question - can I be arrested at my work place without a warrant? I will be starting a new job soon. I have been charged with a misdemeanor crime by the police (without them ever interviewing me). I have learned that they went to court to apply for an arrest warrant and the judge denied the request. I have heard that they need a warrant to arrest me at my home, but do they need one to arrest me at my office?

You cannot be arrested by the police without an arrest warrant unless the police observe you committing a crime. What the police can do is request that you go to the police station with them for an interview but you can refuse this request and do not have to talk with the police.

My advice is that you inform the police that you have an attorney and that they should speak with your attorney and stop any questioning. Be polite but firm.

You stated that you have information that the police requested an arrest warrant that the judge denied. This is unusual for a misdemeanor offense.
