When you provide a breath sample to the police after a DUI arrest you will be charged with a DUI under subsection A1. An A1 DUI is driving under the influence with a blood alcohol level over .08. This was determined by the breath test results you provided. An offense for DUI under subsection A2 is for driving under the influence of alcohol. You can still be charged as driving under the influence of alcohol even if there is no proof that you were above the .08 legal limit.

You should have an attorney represent you and protect your interests.

Good luck
