Legal Question in DUI Law in Illinois

Misdemeanor DUI and Deportation

I have been a permanent resident since August 2006, and I am currently 20 years old. Two days ago, I have been arrested and charged with DUI, Bac over 0.08, and improper lane usage. I did drink and drive, and I am planning to plea guilty, because an under 21 driver could only have bac 0.00. However, I am worried that I would be deported, and my questions are: 1) does DUI consider as moral turpitude in Illinois and 2) what is the chance I will be deported?

I do not believe that a DUI is a deportable offense. I further believe, that if you are a first offender, that there are better options for you that pleading guility. And, you may have defenses. You should consult a lawyer. Good Luck!

DUI is not a deportable offense. Do not attempt to plead guilty until you've spoken to an attorney.

Re: Misdemeanor DUI and Deportation

You are confusing zero tolerance and DUI laws. For DUI, the State will have to prove you guilty beyond a reasonable doubt of driving while being .08 or more (or in one of the other ways DUI can be committed).

Also, DUI is not a deportable offense.

You should consider hiring a competent DUI lawyer -- a legal guide and counselor would help make sure you make sound decisions with your case.
