does a DUI stay on your record indefinitley. Or does it depend on the state

It does not go away (unless you can prove you never did it). That makes sense right? Just because you did something 10 years ago doesn't mean all of a sudden you no actually committed the crime. The punishment decreases with age of the violation though.
