I was approached by an officer while I was sleeping in the front seat of my car while it was running. He asked if I was drinking I said no! He told me to move my car into a parking spot and he left. So I did. A little while later I drove off and within a few minutes he was pulling me over? (illegal lane change?) Can I get the charges dismissed based on the fact he didn't arrest me the first but then follows my and arrests me. I really was driving fine

It sounds like you have a good case. The fact that the officer "let you go" can be used against the State. However, you can't get the charges dismissed based on that fact. An experienced, competent lawyer will know how to approach a hearing. Please seek legal help ASAP.
