Legal Question in DUI Law in Illinois

My son had a fine payment that was due on 10/27, I mistakenly thought it was due on 10/29. When I went to the circuit court office to make his payment I was told there was a bench warrant for his arrest and was not allowed to make his 30 dollar payment today. I was told his bond would be 200 dollars and I could bring him in to the station and they would book him, I could pay the bond and he would be released right back to me. However, when I looked his case up on the website it states a "Summons to revoke court supervision" has been filed and set for 11/22/10. Is the bench warrant and the summons the same thing? If so, should I wait for him to be served or take him to the station as I was advised?

You have a couple issues going on here. First, you should not turn him in to the local police station for booking. Rather, you shoud appear before the judge who issued the bench warrant and file a written motion to quash the warrant. Second, you need to find out why there is a Petition to revoke his court supervision. I would be surprised if it was for missing a $30 payment. If supervision is revoked, so too will his license.

Since you posted this under the DUI topic, I am assuming your son is 16 or 17 years old and what drinking and driving, which is why you are trying to handle this for him. Word to the wise: Hire an attorney. You have too many potential pitfalls that need to be avoided. Only an attorney can help you and your son avoid them. Good luck.
