Elder Incompetence

My mother's husband is not cooperating with the 24 hour care needed for our mother. He is not our father but the man our mother married 10 years ago. She is 76 and presently in need of 24 hour care either in a nursing facility or at their home. He is too weak to care for her. He is 84. What can we do to get the care our mother truly requires?

You will have to go to court to gain guardianship over your mother. Please seek the advice of a lawyer soon.

You need to either get guardianship of her or have her declared incompetent.
