child who won't go back to her custodial parent

My daughter lives with her father. She has informed me that she does not want to go back there after christmas break. If she refuses what is going to happen to her, will she or I get into trouble from the police if her father calls them?

In short, yes, if there is a court order saying dad gets custody. You need another court order to modify that - the court looks to the best interests of the child. If nothing has really changed in the parties' situations, it may be that the judge keeps the child where she is. Most kids have bad times with their parents - it does not mean a court will change custody.
