Custody/Visitation

I have three children(11, 10, & 9)that were born out of wedlock, biological father pays child support but has not had any form of contact with them since before his marriage in Feb of 1999. The children have always resided with me, do I have legal custody automaticly or must something be filed in the courts in case the biological father attempts to file for custody (joint) or visitation rights. What options do I have?

You do not have "legal" custody until you or him go to court and battle it out.
