Leaving Spouse or Abandonment?

Is there any way I could be penalized in divorce proceedings if I take my children 1 from current marriage and 2 from previous, and go stay with my family (30 minutes away) until divorce papers can be drawn and delivered and etc? Is that in some way abandoning the home and property and etc?

Hello and Happy New Year. In my opinion you will not be penalized for leaving your husband and taking your kids with you. However, the Court will want dad to see the children regularly and in their best interest. I will be happy to discuss this with you further and in more detail.
