Left behind

My husband left our home and 2 children in Nov 02. He now lives with his girlfriend and her son. He was served with papers 2 weeks ago. I asked for the house (purchased in Nov 01 for him to quitclaim), child support (retroactive), health insurance-kids & life-him, part of his 401K, arrearages from the day he left, maintenance (I'm unemployed), full custody, and half on daycare when I resume working. I filed mental cruelty. He only makes about 35K in reported wages, but is a DJ in unreported wages of about $350 per function in which I have proof that he has been providing these services. Do you think I will get everything I'm asking for? If not, what in your opinion will I get? How would you advise him?

What you get is up to the judge - if you have proof, provide that proof to the judge and he will determine what is fair.
