Non-Custodial Parent looses job - how can we put a temporary stop on the support

Hello. My husband has 2 children from his previous marraige. He has always paid any and all support required, however a few weeks back lost his job. We have notified his X, however have not yet petitioned the court to modify. My husband and I both work full time (except for lately) to support our son and his 2 children. It is necessary to use an attorney to file a petition or can it be done by an individual? We really cannot afford an attorney to take care of this unless it's a flat rate. Any recommendations.

Hello. I suggests that you hire an attorney. It

is difficult to represent yourself. A person is

usually at a psychological disadvantage, not to mention the fact, that there is a good possibility that a lay person will not have enough experience to maneuver through this court process. I will be happy to answer any additional questions that you might have.

It is possible to represent yourself in this type of matter, however as the previous reply there could be problems doing it yourself. Remember that a person representing themselves is held to the same standard as an attorney. That means that the court expects you to have the same knowledge as an attorney does and expects you to be able to file the proper petitions and supporting documentation.

If your husband expects to find work in the next few weeks then filing a petition is not the best way to handle this situation.
