Legal Question in Family Law in Illinois

Release of bank funds

Good morning,

My dad died a few weeks ago and I am in need of a legal release form which gives me consent to access funds from his bank. I need to pay for burial expenses, so this is needed ASAP. can you give me the name of the form. I guess the bank needs to protect itself.

Thanks,

Re: Release of bank funds

The form is called a small estate affidavit. However this form can not be used in every situation. If your father owned real estate and or the total estate is greater then $50,000 the you can not use this form. If your father left a Will then that Will needs to be filed with the court clerk and an estate opened.

I suggest you speak with an attorney before you take any further action.
