Legal Question in Family Law in Illinois

Privacy Issue Regarding Financial Information

My husband submitted his financial info to his ex's lawyer because she wanted an increase in child support. We do not have & CANNOT AFFORD a lawyer. We also demanded that he did not share or allow her to see the financial info with her. When my husband spoke w/her lawyer he asked if he had share this info with her and the lawyer stated ''of course!'' Is this legal? Can he allow her to view our tax returns and bank statements? I was under the impression that this was sensitive and private information. I also know that she has shared this ''sensitive and private'' information with her family because she has made threats against my husband about IRS fraud and that is just ludicrous!!! I feel this is a huge invasion of our privacy as we do not get to view HER finances, nor does she have to prove the ''substantial increase in circumstances in the needs for the children.'' Aren't their privacy laws that protect my husband and I against issues such as this?

Re: Privacy Issue Regarding Financial Information

If you look at the divorce decree no doubt you will see language which states your husband, the non-custodial parent, is required to provide a copy of his tax return the the ex-wife every year. This is perfectly legal. Now since the lawyer of the ex has the obligation to share this information to his client then of course the ex is going to see the information submitted. Now the fact that she then turns around and shares the info with her family is very petty on her part.

If in fact she is asking for an increase in child support then she has to go to court and request the judge modify the previous order. In order to do that she has to show a substantial increase in your husbands finances. Your husband then has a right to argue that there should be no increase for x y and z reasons.

Hope that helps.
