Legal Question in Family Law in Illinois

Question about Restraining Orders

My daughter is thinking of placing a restraining order against her ex-boyfriend. She claims that he twisted her arm and pulled her hair, but has no proof of it. She doesn't want to file charges but does want to keep him from contacting her. She doesn't feel threatened by him, she just wants to keep him at a distance. What options does she have?

Also - he has threatened her with a ''false accusations'' law suit. Does he have a case''?

Re: Question about Restraining Orders

Hello. Your daughter can get an order of protection against her ex-boyfriend. That is

probably in her best interest and in the best

interest of your entire family. She should do

this immediately. The law in Illinois does not

tolerate domestic violence. As to a lawsuit,

it will go no where in this context. Your daughter has a right to seek an order of protection... this does not constitute grounds

for libel or slander, even if the accusations were

false. The law in Illinois does not place that

type of burden upon victims of domestic violence.

I will be happy to answer any additional questions

that you might have.
