Legal Question in Family Law in Illinois

out of state v. country

In my court order for custody it states ''each party may temporarily take child out of state for vacations.'' my question.... ''Is taking a child out of state as worded also allow taking child out of country?'' I just got a ''Motion to Compel'' other party wants to get a passport for child, stating that they have asked me to cooperate. However this is the first time I've heard anything regarding a trip out of the country.

Out of the country is a bit trickier. If you have concerns I would appear in court on the date the motion will be presented and tell the judge what you are worried about. Ultimately it falls to the judge to make the decision.

It would not hurt for you to get a lawyer, please feel free to give us a call if you have any questions.
