Legal Question in Family Law in Illinois

I am a teen mother of a nine month old baby. I recently have decided to move to Florida after I graduate high school. My problem is i don't want to be charged with parental kidnapping. her father is on the birth certificate but is only involved when its convenient for him, he dose not pay child support and has only gotten a total of 3 boxes of diapers her whole nine moths. so my question is can i be charged with anything if he decides to be spiteful and press charges?

You wouldn't likely be charged with kidnapping but you could seriously jeopardize your custody of the child. You need to file a Petition in the Circuit Court asking the court to order your ex-boyfriend to pay support and awarding you custody with permission to remove the child to Florida. If you go without court permission, you will always be looking over your shoulder and at anytime your ex could petition the court to order you to turn the child over to him. Based on what you have said, if you have a good reason for moving to Florida, the court is unlikely to deny you. I am concerned, however, because you say you are a teen mother but you don't say what your age is. Proceed with caution.
