Legal Question in Family Law in Illinois

I have full custody on my 4 childern. but my ex husband has the childern 1 a week. my question is Sunday i found out by ex was shop lifting (stealing) and showing my son who is 12. I spoke to my attorney and he told me that it would be quite expensive to press charges and will make my son choose sides. what can I do? What is my legal right. my ex also had sex in front of my 2 sons. What can I do I feel so helpless.

Tring to teach my childern in having morals.

If you told your attorney what you are writing here and he did not think it was a good idea to go to court, I think it is time to get a new attorney.

It will cost some money to go to Court to get visitation modified, but I think you recognize that you need to take care of your kids.

You have to know that it is best for your children to not be around such behavior. Sounds like supervised visitation would be best. If you have an attorney, you should speak with him. If you are unhappy with his advice, you need to choose if he is right for you.

It may, in fact, be somewhat expensive, but if you are seriously concerned about the well being and upbringing of these children, then you should go back to court and seek some modification of the existing court order. It may be possible to obtain an order that would require your husband to visit the children only under supervised conditions, and perhaps undergo some counseling concerning his behaviour as it effects the children. Please consult with another attorney.
