Legal Question in Civil Litigation in Illinois

breach of verbal contract

My friend asked me to use my credit to purchase her engagement ring in June of 2007. My credit was approved and the ring was purchased with the agreement that her fiance (now husband) would make the payments. After many months of late payments, the wedding took place in June of 2008 and the payments stopped completely. The account has gone to collections. I've spoken with him and he keeps telling me that he's going to get the bill taken care of. I've suggested that they give me the ring back so that I can give it back to the Jeweler (or sell it and pay the loan) but they won't give it back. What is my legal recourse?

Re: breach of verbal contract

If you have any proof and evidence that your payment for the ring on your credit was not a gift, you can file a lawsuit in the amount of the credit plus all finance charges. But you will have pay the collection agency right away because all they know is your credit and will come after you for collection... as they have.

If you do not have any evidence that the ring was purchased on your credit and there was an arrangement for them to pay you back, then may not have much to go on...

I hope this helps,

Taradji
