Legal Question in Civil Litigation in Illinois

Denying Medical Attention To Dog

I placed a young Lhasa Apso in the Winter of 2005. The new owner signed an agreement (contract) that they would assume complete responsibility for all medical needs the dog may have. For any reason they were unable to keep the dog, to contact me at any point. After the fact of taking the dog to the vet saying it was sick and insisting the dog be euthanized for no specific reason, the vet requested bloodwork and found nothing. Speculation from vet reports to my veterinarian could indicate poisoining or trauma, etc. The woman contacted me after the fact wanting another dog. No further results could be found as they cremated the dog thus not being able to have a necropsy to determine the demise of the dog. Basically she signed an agreement to take full responsibility of the dog, provide a good home and if was not capable to contact me immediately and had all my phone numbers. The whole story was the initial phone call 2 weeks ago saying how much they loved the dog and would like another like her never mentioning any illness, nor does the veterinarian record indicated any illness prior to this. This dog was given in good faith and was a sweet loving animal who did not deserve ignorance of the contract she signed.

Thank you~

You've stated no question. If you question is, can you sue for breach of contract against the dog buyers -- you can but you will never be able to prove a damage claim and therefore your claim will fail. If you want to know if you can refuse to sell another dog to the dog buyers, of course you can. While I'm sure it's very sad that a dog may have needlessly put down, you are best served avoiding contact with these people and moving on. Nothing you can do will bring the dog back.
