Legal Question in Civil Litigation in Illinois

motion for new trial?

I, plaintiff, filed my car accident case to small claim court after 5 months negotiation with defendent's insurance company since I can not accept their low offer. but defendent's attorney demanded jury trial. I won mandatary arbitration on March 14 2006 and jury trial on Nov 13 2007. 12/13/07 defendent attorney filed motion for a new trial request and motion court date will be 01/07/08. My question is

The plaintiff's ''opposition of motion'' should be filed within 14 days from 12/13/07 or i can ask the motion judge to allow me 30 days to file opposition of motion from Jan 7 2008?

Re: motion for new trial?

Very impressive that you have gotten this far.

You can ask the Judge for more time to file your Response in Opposition to Defendant's Motion for a New Trial. Generally, you should get 28 days and they will have another 14 to Reply.

I hope this helps--
