How can I legally marry my fiance if he does not have his legal papers and is not a citizen? He is currently living in the US and working as an undocumented alien.

Re: Marriage to an undocumented person

Generally, a person who entered the U.S. illegally is not permitted to acquire permanent residence from within the U.S. He would have to leave the U.S. and acquire a visa from the U.S. consulate based on your marriage. However, there are serious consequences for being in the U.S. illegally and then departing; therefore, you should hire an attorney to assist you with any such filings.
