Legal Question in Insurance Law in Illinois

hello my name is Mercedes my car was hit whiled parked on 6/06/09, I had just bought my car from a dealership, the parties insurance ignored my calls and took two weeks to answer one message, so I did everything through my insurance. My insurance pay the finance company what the car was worth. I got stuck paying the ramainder on the car that was 1,300. I was never provided a rental and I had no car replacement, Im going to work on the bus and taking my children on the bus to the babysitters house. What can I do in my case? Please give me helpfull advise.

If you never purchased GAP insurance, then you are stuck paying the amount that the insurance didnt cover. GAP insurance is usually offered when you purchase the vehicle. When your car is totaled, the insurance company determines its value and gives that amount to the finance company. If there is still a balance due, then you pay out of pocket, unless you purchased GAP insurance, which in this case, you didnt. Also, look at your insurance policy and see if there is a provision for rental cars, usually you have to add that option to your policy, and it costs a few dollars a month more in premiums.
