Legal Question in Insurance Law in Illinois

settlement money

my daughters dad is incarcerated; he is due to get money from a settlement agreement. He told me I could have it to care for our daughter. I'm not sure how to go about this. My daughter and I live in Arizona, I have a good job so I am not on aide of any kind and I have never went after him for child support since for the most part he has been locked up 3 of the 4 yrs of her life. We did live in Illinois almost a year ago and I was on assistance there, furthermore his mother has a legal document pertaining to if he should die the money goes to her. thank you.
