Legal Question in Intellectual Property in Illinois

poor legal help

I hired this Attorney on 6-9-08 to do the Utility Patent Application. This Attorney stated in writing it would take about a month. This Attorney failed to provide proof that he filed on time (7-17-08) to maintain protection. This Attorney assures me that an ''extension to file'' has been enacted and I have nothing to worry about. It has been one excuse after another and I have given him deadline after deadline to provide me information on this ''extension to file'' and file the Utility Patent Application. I believe something is fishy here and I am seeking counsel to help in this matter. 95% of all correspondences with this Attorney have been in writing. He even ''cites'' himself for his lack of performance.

My Marketability Analysis came back as having an over 300 million dollar market.

This sounds like a case of malpractice. Please report him to both the State Bar of Illinois as well as the US Patent Office.

The big question is whether he furnished you a filing receipt for the patent. If not, then it probably wasn't filed.

Was there a provisional patent application filed? If so this may give you provisional or temporary protection to work from.
