Legal Question in Juvenile Dependency in Illinois

my 15 year old daughter has many problems in high school I no longer want her to attend .I want her to go to an alternative school.Can any legal action be taken against me the parent??

Illinois has truancy laws. See 105 ILCS 5/26-1 in particular. Basically she is supposed to be enrolled somewhere through age 16 and actually attend except for absence for "valid cause" defined as "illness, observance of a religious holiday, death in the immediate family, family emergency, and shall include such other situations beyond the control of the student as determined by the board of education in each district, or such other circumstances which cause reasonable concern to the parent for the safety or health of the student." The last clause is the squishi-est but it's there. But if you just mean can you take her out of public school and either enroll her in private school or possibly home school her, yes you can. Home schooling has some requirements. Otherwise if you just keep your child home from the school she's enrolled at - that is a problem and yes the parent can be liable and the school authorities can theoretically come and take her to school, except as the law provides. If you need to consult an attorney then you will want one who includes "school law" in his or her practice.
