Legal Question in Employment Law in Illinois

We have a problem with cell phones in the workplace. We do have a policy stating if you are caught using your cell phone at work you will be written up and/or suspended. My question is can we legally confiscate an employee's cell phone if caught using and are we liable for invasion of privacy or harassment if an employee records or photographs another employee on their cell phone

If the only purpose of the rule is to avoid employees stealing company time by taking personal calls, very unlikely. If the purpose is to avoid such incidents because there had been a pattern of them in the past, possibly.
