A sales rep left our company released by us) signed a non-disclosure agreement with us and has now gone to work for a competitor. Now he has begun calling our biggest customers. What is our recourse?

You may have a number of courses of action available to prevent the former employee from contacting your customers, but it all starts with a review of the agreement in place. Non-disclosure and non-compete agreements can be difficult to enforce if they were not drafted properly in the first place. Moving forward, you may pursue a breach of contract action against the former employee and ask for an injunction to prevent contact with your customers. You may also bring a tradesecret misappropriation claim and seek the same type of injunction. There are a number of ways you can approach a court to prevent the contact (and your business), but the first step is to have your agreement reviewed by an attorney so that you can form a specific plan.
