Legal Question in Employment Law in Illinois

I was given a termination letter from my job that said I quit but I was told my position could not be held. When a gave rhen my note from my doctor they voided the termination. Now they told me I have 6/8 wks to return or I voluntarily resign. Do I have a case or options can they block my unemployment if I dont go back? Also they are not holding my position that I had but would find me a job with the company

The answers to your questions depend on determining whether you have a serious medical condition and if FMLA applies and/or if your medical condition is of such a nature as to qualify you for protection unde the Americans with Disabilities Act. In any case, if you have a note from a doctor that provides you are unable to work for a specified duration of time and your employer fires you, you should be eligible for unemployment benefits.
