What is the timeline for filing a medcial malpractice claim?

In Illinois the statute of limitation for a claim of medical malpractice is 2 years from the date the injury has occurred or two years from the date of discovery of a cause of action. But in any event, no more than 4 years after the date of injury.

Generally, the statute of limitation for a claim of medical malpractice is 2 years from the date the injury has occurred or two years from the date of discovery of a cause of action. In any event, no more than 4 years after the date of injury.

However, when a minor (under 18) suffers an injury because of medical malpractice, the action must be filed within eight years of the date of the injury, but in no event after the person�s 22nd birthday.
