Legal Question in Personal Injury in Illinois

Car accident

I was in a car accient on 7-05-08, I was in posession of my friends vehicle, but i was parked at gas pump when the lady hit me and the car. I had liability insurance at the time, but the other driver who was found to be at fault did not. She was arrested and her car was towed. Can i still take her to small claims court for the injuries i sustained?

You can but why would you? Collecting a judgment against a person is will take time and hard work and in the end it is not clear whether you will see a dime.

I suggest you make a claim under the uninsured motorist coverage of your friend's insurance policy. That is your best hope to collect anything at all.]

You have insurance coverage for this claim.

If your friend was insured they have coverage for "un"-insured motorists, such as this driver, generally in the same amount of coverage as "bodily injury" coverage for their own liability.

If your friend is un-insured, you likewise have un-insured motorist coverage for this injury.
