Legal Question in Personal Injury in Illinois

driver w/no auto insurance....lawyer requests sister's insurance

My brother was hit by a car. My brother being a pedestrian. Lawyer discovers driver has NO AUTO insurance...(provided motorcycle insurance).

Lawyer requested my sister's insurance to use as the insurance that would cover my brother's medical serious leg injury and costs...stating that then, the driver will have to reimburse my sister's insurance for money withdrawn to cover injury....

Is this legit? Is this legal??? My sister's car was NOT involved or even present at the time of the accident. The man has no insurance, why should it become my sister's insurance problem? Please advise...

Your brother may be covered by your sister uninsured motorist policy. If that is the case, then your brother could make a claim against your sister's insurance policy.
