Legal Question in Personal Injury in Illinois

Need advise on existing suit

I was involved in an accident in 2004. Person involved claimed responsibility. Bac injury accured,cant work per doc's. My attorney is given very little info to me (we get paid if u get paid) no offer, she tells me now that it will go to trial to prove if I am really disabled. This she claims will take another year or 2. I am about to lose everything I had worked for. Could u please tell me if this sounds like it is normal. Insurance co. is involved. I thought after 8 months of therapy and numerous test and no better results that anyone can clearly see that I AM INJURED. I have been approved and recieve disability. But nothing compared to my usual earnings. Thank u 4 your time. [email protected]

This is normal. The defendant has a right to require you to prove your case in a court of law and has a right to defend the matter. It may be obvious to you that you are injured, but to be legally entitled to a settlement, you must prove, based upon a preponderance of the evidence, that you were injured and that your injury was proximately caused by the defendant's negligence.
