Legal Question in Personal Injury in Illinois

My mother was killed in a auto accident, police report states she is at fault. My question is does the insurance company have to pay out more than just accidental death benefits that we pay for? The other driver had the same insurance company.

I am sorry for your loss. A police report may not be the final word on who is at fault. You should have an attorney investgate the situation for you. Most attorneys will do so and only charge you if he or she is able to obtain a settlement or judgment for your family.

Mr. Padove's advice is quite sound. You also have to resolve the issue of insurance coverage provided by the two policies: your mother's and the defendant's.
